This also includes references to the objects of your exclusive right. Any information on the HOTVIRT resource can be posted independently by each user who has completed the registration procedure. The Administration performs inspections due to its technical and other capabilities, but cannot provide full and comprehensive control due to limited resources. This is a common worldwide practice of posting information on social networks and the Internet.
The Internet has a huge number of electronic libraries. According to practice and statistics, such resources are an excellent way to promote information and stimulate user interest, while avoiding causing any damage to the authors of the works.
The administration of the HOTVIRT website does not have sufficient technical capabilities in its arsenal to control all user actions, but at the same time it has a very negative attitude towards copyright infringement on the aforementioned resource.
Therefore, if you are the copyright holder, you have the following rights:
- The exclusive right to his work,
- The exclusive right to public demonstration,
- The exclusive right to make it publicly available.
At the same time, if you believe that your copyrights have been violated in some way by using our information resource, the site Administration kindly requests that you promptly inform the support service about the violation in order to consider the complaint in the form of an electronic letter. Below are the recommendations that we ask you to follow in such a case.
After receiving your letter with the correct and detailed information, the complaint will be reviewed within five business days. We rely on the legislation in force in our country, so the Administration is ready to consider controversial issues in the format of a pre-trial settlement procedure.
If you find any violations, then you must correctly enter the following information in your complaint:
1. Information about the object of the exclusive right in relation to which you have noticed a violation:
- The full name of the object in the original language;
- The official website of the facility on the Internet, if available;
- A copy of the state registration document (if you are a Legal Entity, the Copyright Holder of an electronic publication, computer program or database);
- A copy of the rental certificate (if you are a Legal entity or the Copyright Holder of audio and video materials);
- A document confirming your exclusive rights to a particular image (if you are a Legal Entity or the Copyright Holder of photographs and/or other graphic material).
2. Information about the copyright holder:
- Full name for Legal entities / passport details for Individuals;
- Postal address (if the Legal address is different from the postal address, then you must specify the first of them);
- A link to the copyright holder's website on the Internet, if available;
- If your activity is licensed in accordance with the procedure established by law, then you must attach a license for the right to operate;
- Contacts of your representative (full name, position, phone number, e-mail address).
3. Data of the person who submits the complaint for consideration:
- Full name;
- The position he holds;
- Phone number;
- Email address;
- A copy of the power of attorney for actions on behalf of the Copyright Holder. If you are filing a complaint and you are the head of the Copyright Holder's company, then it is not necessary).
4. The following claim data:
- A link to a website page that contains data that violates your exclusive rights in the following format: https://hotvirt.com/XXXXX;
- The fullest possible description of the essence of your complaint (why do you, as the Copyright Holder, prohibit the dissemination of this information);
- A subscription on the legality of actions is mandatory for any complaint. It must be filled out by hand and sent in scanned form.
The complaint has the following form:
I, "full name", acting on behalf of the "Legal name of the copyright holder" on the basis of the power of attorney "data of the power of attorney", certify that all the data specified in this appeal is correct, the "Name of the person" (Copyright Holder) is the owner of exclusive copyrights, including:
- the exclusive right to reproduce;
- the exclusive right to distribute;
- the exclusive right to public demonstration;
- the exclusive right to make it publicly available.
The above rights are valid on the territory of the Russian Federation, and all issues related to the payment of royalties to the authors of the work are regulated by the Copyright Holder, the Copyright Holder was not aware of the claims of third parties regarding these exclusive property rights.
If in the future there are claims from third parties to the HOTVIRT information resource related to the violation of their rights (both copyright and consumer) and the deleted or blocked publication, the Copyright Holder takes all necessary measures to resolve these claims, as well as possible disputes, including judicial ones.
The copyright holder undertakes to settle complaints, claims, and lawsuits from third parties with compensation to the HOTVIRT resource for all costs and losses (this also includes lost profits, legal fees, and others) related to the resolution of claims, lawsuits, and claims from third parties for violation of their rights, as well as other claims related to illegal or erroneous deletion of a publication based on a complaint from the Copyright Holder.
